CBN GOV. Olayemi Cardoso to appear in court

 


The Kogi Governorship Election Petition Tribunal, convened in Abuja, issued a compelling order on Monday, directing the appearance of the Governor of the Central Bank of Nigeria (CBN), Olayemi Cardoso, on Tuesday. This directive stems from the tribunal's inquiry into the role of the apex bank in the November 11, 2023, off-cycle election in Kogi.


According to reports from the News Agency of Nigeria (NAN), the three-member panel of justices, chaired by Justice Ado Birnin-Kudu, also warned the Director of Corporate Service at the CBN of potential consequences should they fail to comply.


The tribunal's decision followed an application by Alex Izinyon, SAN, representing Governor Usman Ododo of Kogi State, the second respondent in a petition filed by the Social Democratic Party (SDP) and its gubernatorial candidate. The petition raised concerns about the timing of the petition against Gov. Ododo, alleging it was filed outside the legal timeframe of 21 days.


Earlier, on April 18, the tribunal had issued a subpoena compelling the CBN governor or any relevant officer to attend proceedings and provide evidence. However, no representative from the apex bank appeared at the hearing on April 19 as directed.


Subsequently, after witnesses led by Paul Daudu, representing Governor Ododo, concluded their testimonies on Monday, Izinyon conveyed his client's frustration with the absence of CBN officials, citing a letter from the bank stating their unavailability until April 26.


In response, Izinyon labeled the letter as an act of contempt, emphasizing that a subpoena is a directive in the name of the President of Nigeria. He insisted that the CBN officials must appear to testify, emphasizing the time-sensitive nature of the matter.


Aliyu Saiki, SAN, representing the Independent National Electoral Commission (INEC), and other legal counsels aligned with Izinyon's application. They urged the tribunal to proceed with caution and ensure the fair administration of justice.


In its ruling, the tribunal reiterated the significance of the subpoena and the importance of the CBN's compliance. Justice Birnin-Kudu emphasized that failure to appear would be duly recorded and addressed accordingly.


Consequently, the tribunal adjourned proceedings until April 23 to allow for the continuation of Governor Ododo's defense and for the CBN to justify its absence.


Meanwhile, Izinyon also requested access to the record of proceedings to ensure accuracy and transparency in the legal process. Justice Birnin-Kudu assured that the records would be made available to the defense team.


Earlier witnesses, Enesi Adavi Mohammed and Jimoh Onimisi Biodun, testified in defense of Governor Ododo's election victory.


The unfolding legal drama underscores the gravity of the allegations surrounding the Kogi election, highlighting the importance of transparency and accountability in electoral processes.
